Welcome to Prakrit Living, a high-quality handcrafted home decor brand of Prakrit Enterprises. The following Terms and Conditions govern your use of our website and your purchases of our products. They are here to give you a clear, fair, and transparent shopping journey through our collections, a shopping journey you will want to take with confidence and a piece of Blue Pottery heritage from Jaipur in your home.

By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these Terms, we kindly ask that you refrain from using our website or purchasing our products.

1. Acceptance of Terms

These Terms apply to every visitor, customer, and user of the Prakrit Living website, regardless of whether you make a purchase. By using the site (viewing products, signing up for an account, subscribing to our newsletter, or simply visiting our site), you agree to these Terms and accept the policies outlined in our Privacy Policy, Shipping Policy, and Return & Exchange Policy, which are incorporated by reference into this agreement.

We may revise these Terms from time to time, as explained in Section 20 below. It is advisable to follow up on the website from time to time, especially prior to ordering.

2. Eligibility to Use the Website

To use our website or place an order, you must be at least 18 years of age, or the age of legal majority in your jurisdiction, and capable of entering into a legally binding contract under the Indian Contract Act, 1872. We reserve the right to refuse service, close accounts, or cancel orders where we reasonably believe these eligibility requirements have not been met.

3. About Our Products

All products available on Prakrit Living are handmade by artisans of Jaipur, who are skilled in the art of Blue Pottery, as well as other handmade ceramic and home decor handicrafts with countless years of tradition behind them. We describe our products, materials, and dimensions as accurately as possible, and we very carefully take photographs of every collection that you can expect to receive.

However, some colours may look slightly different on the screen and in the lighting conditions, depending on the settings of your device. The colours you view on screen are not guaranteed to be exactly the same as the product.

4. Handmade Product Variations

This is essential, and we are honest about it: Our products are handmade, so they will never be the same.

There may be slight differences in the tone and brushwork, colour intensity, surface finish, and even size and form variations, sometimes even within the same set, of the same design. These are not defects, imperfections,s or manufacturing errors. They are the hallmark of the artisan who created your piece, and a natural, expected quality of handcrafted Blue Pottery and ceramic work.

5. Pricing

All prices listed on our website are in Indian Rupees (₹) unless otherwise stated and are inclusive of applicable taxes unless mentioned otherwise at checkout. International customers may be charged in either their local currency or the currency used at checkout, but the transaction will be settled in the currency listed at checkout.

Product prices are subject to change without notice and are subject to change due to changes in materials prices, artisan wages, or market conditions. Price changes will not impact confirmed orders that have been paid for.

Although we do our best, sometimes a product is listed at the wrong price because of a technical or human error. If this happens, we will contact you before processing your order to confirm whether you'd like to proceed at the correct price or cancel the order for a full refund.

6. Product Availability

Availability may change rapidly, and our pieces are handmade in limited quantities. Although our website is updated as brands keep new products available, there is a possibility that a product might sell out or become unavailable after ordering in rare circumstances.

If this happens, we will notify you as soon as possible and offer you the choice of:

Waiting for the next batch, where applicable
Choosing an alternative piece of equal value
A full refund

7. Orders

7.1 Placing an Order

When you place an order through our website, you are making an offer to purchase the selected product(s) at the listed price. Placing an order does not guarantee acceptance.

7.2 Order Acceptance

We at the company reserve the right to accept or reject any order, in whole or in part, including, but not limited to, product unavailability, pricing errors, suspected fraudulent activity, inability to verify shipping information, or restrictions on delivery of the products to the intended location. Once the payment is made, we offer a complete refund if you are not pleased with our product as per our Return & Refund Policy.

An order is considered accepted, and a contract of sale formed, only once we send you an order confirmation email and your payment has been successfully processed.

7.3 Order Cancellation

You can cancel your order before it is dispatched, according to our Cancellation Policy. An order that has been shipped is not eligible to be cancelled; however, it may be eligible for a return once the product has been delivered in accordance with our Return & Exchange Policy.

We also have the right to cancel any order, e.g., if something is found to be damaged or out of stock after the order is placed, if fraud is suspected, or for any other reason, in which case we will inform you and pay a full return of all amounts paid.

8. Payment

8.1 Payment Methods

Payment can be made using credit and debit cards, UPI, net banking, and digital wallets via our secure third-party payment gateway. Payment information is handled as explained in our Privacy Policy; we don't store your full card and banking information on our own servers.

8.2 Cash on Delivery (COD)

Cash on Delivery is available where provided and will apply to the terms outlined at the checkout and in our Shipping Policy, which may include an order value restriction and/or handling fee. We reserve the right to refuse to accept COD payments on selected orders, PIN codes, or customers at our discretion (for example, if repeated non-acceptance of COD deliveries has occurred).

8.3 Payment Security

All transactions made online are handled by secure, encrypted PCI-DSS-compliant payment gateways. Although we take reasonable precautions to ensure the security of your transaction, we do not guarantee that the transmission of data over the Internet is completely risk-free, and transmission of data over the Internet is at your own risk.

9. Shipping and Delivery

Shipping timelines, charges, and courier partners are detailed in our Shipping Policy, which forms part of these Terms. It can be just as simple as that—orders are received and sent out from our Jaipur studio, and delivery varies depending on the location. Our products are delicate and handmade; therefore, we pack them carefully for every order. Please inspect your parcel right after delivery and let us know if you have any concerns within the limits of our Shipping Policy.

Our Delivery Time is an estimate; it is not guaranteed. We use trusted courier service providers, but we cannot be responsible for any delays that happen for reasons beyond our control.

10. Returns, Exchanges, and Refunds

Our terms regarding returns, exchanges, and refunds in detail (including the treatment of natural handmade variation, and timelines and eligibility) are outlined in our Return, Refund & Exchange Policy, which is part of these Terms. We do strongly recommend that you read these policies before ordering, especially the handcrafted variation and non-returnable sections.

11. User Accounts

By creating an account with us, you will be responsible for the security of your account and any activities you carry out in the account. If you feel that your account is being misused, please contact us as soon as possible at info@prakritliving.com.

When creating an account or ordering, you are responsible for providing complete, accurate, and up-to-date information and updating it. Any account that includes inaccurate information, fails to comply with these Terms, or is misused for fraudulent or illegal uses will be suspended or terminated at our discretion.

All the information and descriptions of products, pricing, photos, and other content on our website are accurate and up to date to the best of our ability. We cannot, however, guarantee the accuracy, completeness, or reliability of the information on the website. We may amend, update, or correct any information at any time without notice, including after a purchase is made, and without liability.

The designs on our website, the art form, and the techniques of Blue Pottery are traditional art forms of Jaipur, Rajasthan; the craft itself is not proprietary to us, but the design of the product, photography, and the brand content are.

15. User-Generated Content and Reviews

By submitting a product review, comment, photograph, or any other content to us (whether by posting it on our website, on social media, or by emailing us), you grant us, Prakrit Living, a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish and display such content (with appropriate attribution where reasonable).

We may monitor, edit, and remove, at our sole discretion, any content from users, including reviews that we deem to be fraudulent, abusive, or that are not relevant to the product in question.

We will be unable to accept responsibility for any failure or delay in fulfilling our obligations, including order processing, dispatch or delivery, where the failure or delay is due to factors outside our reasonable control. This includes, without limitation, natural disasters, fire, flood, strikes, artisan or workshop disruptions, courier or logistics failures, government action, pandemics, civil unrest, or internet or telecommunications outages. In these instances, we will do our best to contact you and return to normal operations as soon as possible.

These Terms are subject to change and may be amended from time to time as we see fit to adapt to changes in our practices, offerings, or applicable law. These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms, or your use of the website, shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India.

25. Dispute Resolution

We respect our customers and prefer to discuss issues face-to-face. If you have a dispute or grievance, we encourage you to first write to us at info@prakritliving.com, so our team can work toward a fair resolution.
If the disputes are not resolved by mutual discussions within a reasonable time, one of the parties may attempt to resolve the dispute through mediation or arbitration in Jaipur, Rajasthan, in terms of the Arbitration and Conciliation Act, 1996, rather than by litigation, unless consumer protection law provides you with the right to file a case before a consumer forum directly.
